Privacy Policy

Information pursuant to Articles 13 and 14 of the European General Data Protection Regulation (GDPR 2016/679) and the German Federal Data Protection Act ("Bundesdatenschutzgesetz" DE BDSG), as well as the German Telemedia Act ("Telemediengesetz" TMG) on the processing of personal data.

We would like to inform you about the processing of your data on our websites and within our business processes. The lawful and fair processing of your data is important to us. When you purchase one of our products or use one of our services, a business relationship is established that requires us to store some of your personal data. Here you can find out which data we collect for what purposes and what your rights as a data subject are.

Purpose and legal basis for processing

Our websites do not require the entry of personal data. Likewise, we do not use cookies or third-party analysis tools on the web.

The general terms and conditions of Apple apply to the purchase of the RTFC Translator App.

When using the RTFC Translator App, technical usage and diagnostic data that we do not use to identify users is collected by us. This data does not allow any conclusions to be drawn about you as a user and cannot be assigned to your Apple account.

Personal data is stored by us solely for the purpose of providing services, training, technical assistance or consulting, as well as for distributing our newsletter:

Usage data on the Web
Whenever our web pages are accessed and when a file is downloaded, general data is automatically stored in a log file. The storage serves to protect our legitimate interests in the context of copyright (copy protection), as well as for statistical purposes and in exceptional cases to report criminal offences (Article 6(1)(b) and (f) GDPR).

In detail, the following data record is stored about each download:
1. name of the retrieved file
2. date and time of the retrieval
3. amount of data transmitted
4. the success status of the download
5. description of the accessing program (in case of a download by our software this description contains a pseudonym for the licensee)
6. the operating system used
7. the IP address of the respective Internet connection used
Usage data of the app
When you run the RTFC Translator App, usage data is collected automatically to help us improve the app. In the event of a crash, additional technical information is transmitted to help troubleshooting the app. The data allows to narrow down the cause of a crash by analyzing the call stack of the program. The storage serves to protect our legitimate interests in the context of software development, (Article 6(1)(f) GDPR).
services
In order for us to answer your requests, we need your master data, i.e. name, address, phone number and e-mail address. In addition, we store which of our products you have purchased and when and also which of our services you have used.
Software distribution and invoicing are carried out electronically via the Apple App Store and is subject to the general terms and conditions of Apple.
Trainings
If you make use of one of our training courses, in addition to your master data we may also collect information on the intended use of our software, your previous knowledge, your need for assistance and the requirement profile of your employer. Any health related information provided is voluntary and solely for the purpose of individually tailoring the respective training.
Technical assistance and consulting
In order to provide you with advice and assistance in resolving problems, we need information about your system environment (the version of the operating system and RTFC software), third-party programs that may interact with the RTFC software, your hardware (device type, computer architecture, Braille printer or braille keyboard), as well as detailed information about your requirements and approach.
For this purpose, we usually document conversations.
If we need sample texts or other data to diagnose a problem, it is up to you to send us any data. We ask you to ensure compliance with the GDPR, the DE BDSG and the TMG yourself when you send us data for testing purposes.
Sending our newsletter
If you would like to subscribe to our newsletter, we only need your e-mail address. Providing your name or other data is voluntary. You decide how to send us this data. You will then receive a confirmation mail to ensure your consent and identity and to prevent misuse (double opt-in procedure). If you do not reply to the confirmation mail, your e-mail address will be deleted again.

Your data is processed on the basis of commercial, tax and copyright law, as well as other legal provisions applicable in Germany and the European Union. If the processing is not legitimized by a legal provision, it is carried out in accordance with Article 6(1)(a) GDPR on the basis of your express consent.

In individual cases, we transmit your data to other recipients with legitimate interest, provided this is permitted by law or if you have consented to such transfer. If you have consented, we may also use your data for purposes other than those stated here. You will receive information about this, if applicable, at the time the data is collected.

Note:

if you send us confidential data (e.g. personal data according to Article 4 GDPR), do not simply use an e-mail to do so. In addition, use a state of the art encryption method like S/MIME. E-mail communication has security gaps which mean that data confidentiality cannot be guaranteed. Security experts therefore like to compare e-mails with postcards, which can be read effortlessly by any postman. Thanks to today's commonly used transport encryption (TLS), e-mails are encrypted all the way to the mail server, but they can still be read by any server that forwards them.

Recipients of your data

Your data is generally processed only by us. Data is only shared with third-parties where this is necessary for the provision of our services, for software diagnostics, or where permitted by law. In doing so, we respect your interests worthy of protection and follow the principle of data minimization.

Third-party products that are included in our software are also subject to intellectual property rights. In these cases, we have acquired the rights to use the third-party products and are entitled to authorize our customers to use the software. This may require to pass on your license data to the respective license owner. Please refer to our Copyright notices on the Internet and in the respective product documentation.

Note:

there is no transmission of data to other recipients or international organizations outside the European Union, unless there is a legal obligation to do so.

Duration of storage

We store your data only as long as is necessary for our business relationship and in accordance with legal requirements. Access logs of our websites and downloads are automatically deleted after three months. Usage and crash data are only stored for the purpose of diagnosing technical issues and improving the functionality of the software. As far as this data does not relate to an identified or identifiable person, it does not fall within the scope of the GDPR. Tax-relevant data such as invoices are only deleted after ten years due to legal retention periods. Service or maintenance contracts that you personally conclude with us may be stored for longer than ten years due to the duration of the contract and limitation periods.
